Terms of Use

1. Eligibility and authority

You must be at least 18 years old and legally able to enter into these Terms. If you use CallForage for an organization, you represent that you have authority to bind that organization.

2. Your account

Provide accurate account information, keep your sign-in credentials secure, and promptly notify us if you suspect unauthorized access. You are responsible for activity performed through your account unless prohibited by law.

3. The service

CallForage helps organize real-world research, review sources, prepare focused business-call plans, and compare results. Features may change as the service develops and may be subject to account eligibility, safety controls, or usage limits.

CallForage is not an emergency service, professional adviser, law firm, medical provider, financial institution, employment agency, or government service.

4. AI-generated information

Research, summaries, recommendations, transcripts, and structured results may be created or assisted by automated systems. They can be incomplete, outdated, or inaccurate. Review important information and confirm it directly before relying on it, especially where health, safety, legal rights, finances, employment, housing, education, or other significant interests are involved.

5. Phone research

You may request only lawful calls for a legitimate purpose. You must have any permission or consent required for the requested call and must not use CallForage for unsolicited marketing, harassment, deception, debt collection, political outreach, emergency communications, or other prohibited activity.

A proposed call does not proceed merely because it appears in a Job. Any calling feature may require separate review, approval, usage limits, recipient protections, and credits. We may refuse, stop, or limit a call when needed for safety, recipient choice, legal compliance, or service integrity.

6. Your content

You retain ownership of the instructions, constraints, files, and other material you provide ("User Content"). You grant us a limited, worldwide license to host, process, reproduce, transmit, and display User Content only as needed to operate, secure, support, and improve the service, comply with law, and enforce these Terms.

You represent that you have the rights and permissions needed to provide User Content and to direct us to process it.

7. Acceptable use

You must follow our Acceptable Use Policy. Do not misuse the service, interfere with its operation, attempt to bypass safety controls, or use it to violate another person's rights. We may investigate suspected misuse and restrict or suspend access where reasonably necessary.

8. Credits, fees, and taxes

Call Credits cost $0.15 each under the current pricing model. One Call Credit covers one owner-approved outbound call attempt. A credit is reserved when you approve the exact call. If the attempt is blocked before the calling provider accepts it, the credit is returned. Once the provider accepts the attempt, the credit is used even if the result is voicemail, no answer, or an unsuccessful connection. A retry is a separate attempt and requires another credit.

Purchased Call Credits do not expire under the current pricing model. You are responsible for applicable taxes. Except where required by law or expressly stated at purchase, used credits are nonrefundable.

Call Credit purchases are billed by Famplified LLC. The charge should appear under the Famplified LLC name on your card or bank statement, although your financial institution may abbreviate it.

9. Third-party services and sources

CallForage may rely on public websites, communications networks, research services, and other third-party services. We do not control third-party content, availability, statements, policies, or business decisions. Links and research results are provided for context, not as endorsements.

10. Ownership

CallForage, its software, design, branding, and service content are owned by Famplified LLC or its licensors and are protected by intellectual-property laws. These Terms do not grant you rights to our trademarks or service except for the limited right to use CallForage under these Terms.

11. Suspension and termination

You may stop using CallForage at any time. We may suspend or terminate access if you materially breach these Terms, create risk for recipients or others, fail to pay amounts due, or expose the service to legal or security risk. Provisions that by their nature should survive termination will survive.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALLFORAGE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE OR ITS RESULTS WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETE, OR SUITABLE FOR A PARTICULAR DECISION.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAMPLIFIED LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITIES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so those limitations apply only to the extent permitted.

14. Indemnification

To the extent permitted by law, you will defend and indemnify Famplified LLC from claims, losses, and reasonable costs arising from your User Content, your misuse of CallForage, your violation of these Terms, or a call you request without required authority or consent.

15. Governing terms

These Terms are governed by applicable United States law and the law of the state in which Famplified LLC is organized, without regard to conflict-of-law principles. Before filing a claim, you and Famplified agree to make a good-faith effort to resolve it by contacting the other party. Nothing in these Terms limits rights that cannot lawfully be waived.

If part of these Terms is unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, financing, reorganization, or sale of the service.
